Agreement
Polar Static is made by Ihar Klionski, an independent developer based in Poland (“we”, “us”). These terms apply to Polar Static for iPhone, iPad, Apple TV and Apple Watch, its widgets and extensions, and the collections sold in it.
By downloading or using the app you agree to these terms and to Apple’s Licensed Application End User License Agreement (the “Apple EULA”). These terms add to the Apple EULA; where the two conflict about the license to use the app, the Apple EULA applies.
What you may do
We give you a personal, non-exclusive, non-transferable license to use Polar Static on Apple devices you own or control, as the App Store’s usage rules allow, including through Family Sharing.
You may show scenes in public: at home and at parties, in venues and shops, at events, in art installations, and in live streams or recorded videos. You don’t need to ask us first. A mention of Polar Static is appreciated but not required.
Clips you record in the app are yours to save and share anywhere, including on social media.
Purchases
- The app is free to download. Some scenes are sold in collections. Each collection, and Everything, is a one-time purchase. There is no subscription.
- Everything unlocks all current collections and every scene we add to Polar Static later, for as long as we offer the app.
- Prices are shown in the app before you buy. Payment is processed by Apple under its terms, in your local currency.
- Purchases work on all your devices signed in to the same Apple Account, and are shared with your family through Family Sharing. On a new device, tap Restore Purchases in the app.
- You can try locked scenes for a short time before buying. How long and how often may change.
Refunds
Purchases are made through Apple, so refunds are too. Request one at reportaproblem.apple.com. If a refund is granted, the scenes it covered are locked again.
If you live in the European Union or the United Kingdom, scenes are delivered as soon as you buy them. When you buy, Apple asks you to agree to immediate delivery, and once delivery starts you lose the 14-day right of withdrawal. This doesn’t affect your rights if a purchase doesn’t work as described.
Health and flashing light
Scenes contain moving patterns and, in Reactive mode, changes of light that follow the music. A small number of people may have seizures or other reactions to flashing light or patterns, even without any history of them. If you or anyone watching has epilepsy or has had such a reaction, talk to a doctor before use. Stop immediately if you feel dizzy or sick, or notice altered vision, twitching or loss of awareness. Don’t use Polar Static while driving.
What you may not do
- Copy, modify, decompile or reverse-engineer the app, except where the law allows it.
- Extract the scenes, shaders, artwork or code and distribute them separately, or sell them as your own.
- Get around purchase checks or unlock paid scenes without buying them.
- Rent, lease, resell or redistribute the app itself.
- Use the app in a way that breaks the law.
Ownership
The app, its scenes, shaders, artwork, and the Polar Static name and logo belong to us and are protected by copyright and other laws. These terms don’t give you any rights to them beyond the license above. Videos, photos and clips you make of the scenes are yours to share, as described in What you may do.
Changes to the app
We keep improving Polar Static, so scenes may look or behave differently after an update. We may add features and, rarely, retire one. If we retire a paid scene, we will replace it with one of similar value where we reasonably can. Some features need a recent version of iOS, tvOS or watchOS.
Warranty
We work hard to keep Polar Static stable, but it is provided “as is”: we don’t promise it will be free of errors or run on every device. If you are a consumer, nothing in these terms limits the rights you have by law, including your statutory rights when digital content doesn’t conform to what was promised.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data or profit, and our total liability to you is limited to what you paid for Polar Static in the 12 months before the claim. This doesn’t limit liability that can’t be limited by law, including for intent, gross negligence, or death or personal injury caused by negligence.
Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it — questions go to us. If the app fails to meet a warranty that applies, you may notify Apple, and Apple will refund the purchase price; beyond that, Apple has no other warranty obligation. Apple is not responsible for any claims about the app, including product liability, legal or regulatory compliance, consumer protection, privacy, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
Governing law
These terms are governed by the laws of Poland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
Changes to these terms
If we change these terms, we will post the new version here with a new date and, for significant changes, mention them in the app’s release notes. The new terms apply from that date; if you don’t agree with them, you can stop using the app.
